Raj Kasireddy, the main accused in the AP liquor scam case, faced a setback from the Supreme Court on Friday. He had filed a petition in the Supreme Court challenging his arrest in the case. A bench of Justices Parthiwala and R Mahadevan was hearing the petitions filed by Kasireddy and Kasireddy's father.
Senior advocates Siddharth Luthra and Siddharth Aggarwal, appearing for the AP government, argued on behalf of the state government. Senior advocates Mahesh Jatmalani, Ponnavolu Sudhakar Reddy and Ramesh appeared on behalf of the petitioners. The court also rejected a petition filed by Kasireddy's father Upender Reddy alleging that rules were not being followed at the time of his son's arrest. The court, which heard the two petitions last Monday, had reserved its verdict.
In the judgment the court said that the case is being disposed of in its entirety without going into the merits on whether the arrest is correct or not. The petition filed by Kasireddy, who claimed that the AP CID was not empowered under CrPC 160 to issue notices to him as he was staying in Hyderabad under CrPC 160 has been referred to a larger bench. The Supreme Court said that matters like regular bail should be taken care of in the High Court and made it clear that it was not referring to them.
