MLA writes letter to Prez seeking support to amend SC rules

Chevella MLA Kale Yadaiah who belongs to the Tiruppan Alwar Ammal (SC/ST) community, on Monday wrote a letter addressed to the President of India Droupadi Murmu expressing support for the community’s efforts to amend the Supreme Court Rules in the context of Article 363 of Indian Constitution.

This is with reference to the Constitutional Rama Rajya dispute involving the Chilkur Balaji deity. He references a letter from the community dated May 9, 2025, and highlights the involvement of former President Ram Nath Kovind and other political figures.

The MLA hoped that the amendment will address the "underlying root cause" of the dispute, ensuring the protection of Dharma (righteousness) as per constitutional mandates under Articles 60, 39A, and 145. The Tiruppan Alwar Ammal community has  deep devotional ties to the Chilkur Balaji Temple. The community has been advocating for the protection of deity rights under Article 26 of the Indian Constitution, which guarantees religious denominations the right to manage their own affairs in matters of religion.

They frame their efforts as ensuring "Dharma" (righteousness) in matters involving deity interests, often invoking the concept of "Constitutional Rama Rajya," a vision of governance rooted in justice and morality inspired by the epic Ramayana. Article 363 of the Constitution limits the jurisdiction of courts in disputes involving pre-independence treaties and agreements between the Indian government and princely states, but the Tiruppan Alwar Ammal  community argues that this provision should be interpreted to protect deity rights in alignment with constitutional morality.

Kale Yadaiah, had previously written in August 2020 to the then President of India Ramnath Kovind and recently on May 19, 2025 seekingt that the Supreme Court Rules are amended to protect deity rights. The Tiruppan Alwar Ammal  community believes that this amendment will resolve the "underlying root cause" of the issue—namely, the lack of mandatory procedural safeguards in cases involving deity rights.

The community’s May 9, 2025, letter to the Supreme Court Rules amendment committee is a pivotal document. It requests consultation with former Chief Justice of India (CJI) M.N. Venkatachaliah and the Attorney General to ensure that the rules align with constitutional mandates and protect deity rights.
